Risk classification: not every agent is «high-risk»

The AI Act distinguishes categories (e.g. unacceptable, high-risk, transparency requirements for certain systems, minimal risk). Many conversational support or sales agents do not automatically fall under the high-risk list in the annexes, but may still be subject to transparency duties or other rules depending on design, sector (health, insurance, HR with significant evaluation, etc.) and context. The practical lesson: classification is case-specific; treat it carefully and involve counsel when the use is sensitive.

Transparency: making clear people are talking to AI

When a user interacts with an AI system in conversational form, the Regulation often requires it to be clear that responses are machine-generated — unless already obvious from context. In practice: initial message, widget label, tone that does not deceptively mimic a real person. That is both compliance and customer trust.

Human oversight and handoff

The core idea is that material decisions or assistance should not depend blindly on automation. Handoff to an operator, escalation for sensitive requests (complaints, personal data, contracts) and rules in the agent instructions are organisational measures aligned with this spirit. Documentation and traceability

Keep a reasonable trail: what the agent does, which sources it uses (knowledge base), which actions it can take on connected systems, who approves instruction changes, how incidents and errors are handled. You do not need a laboratory logbook: you need repeatable discipline, useful in audits or dialogue with authorities and partners.

Read the AI Act together with the GDPR

The AI Regulation does not replace the GDPR: purpose, legal basis, minimisation, data subject rights and vendor agreements remain central. If the agent accesses or generates personal data in logs, privacy by design and internal policies should be coherent with both frameworks. 1) Define the exact use case (FAQs only, or CRM actions, lead qualification, etc.). 2) Assess with counsel whether you approach high-risk scenarios or regulated sectors. 3) Set transparency for end users. 4) Define agent boundaries and human escalation. 5) Document configuration, instruction versions and integrations. 6) Plan periodic monitoring of conversations and fixes. 7) Align model and software vendors with contracts and DPIAs where needed.
